Meghachandra Singh, who articulated a pointed concern: whether the 12th Assembly is still &#8220;alive&#8221;, has become &#8220;dead&#8221;, or must now be considered \u201cdeemed dissolved\u201d in light of the provisions under Article 174 of the Constitution of India.<\/p>\n<p>In the communication addressed directly to the Governor, Meghachandra Singh writes, \u201c<em>The present letter is a communication to you, being the constitutional authority, to ascertain the present status of the 12th Manipur Legislative Assembly \u2014 whether the said Assembly is still alive, already dead, or constitutionally deemed to be dissolved from the midnight of 11.02.2025 onwards.\u201d<\/em><\/p>\n<p>Citing Article 174(1) of the Indian Constitution, which governs the summoning, prorogation, and dissolution of State Legislatures, the Congress leader argued that six months must not intervene between two consecutive sessions of the Assembly. With no sitting held since before. February 11, 2025, the Congress argues that the Assembly\u2019s current status is constitutionally untenable and requires an immediate clarification.<\/p>\n<p>Quoting the provision, the letter notes: <em>\u201cThe Governor shall from time to time summon the House or each House of the Legislature of the State to meet at such time and place as he thinks fit, but six months shall not intervene between its last sitting in one session and the date appointed for its first sitting in the next session.\u201d<\/em><\/p>\n<p>In support of this position, the MPCC letter references the Governor\u2019s own earlier order dated January 24, 2025, in which the 7th Session of the 12th Assembly was scheduled under Article 174(1). However, this order was later revoked by the Governor through another directive issued on February 9, 2025, effectively preventing the session from being held. The Congress contends that with the passage of six months without any legislative session, the Assembly stands constitutionally lapsed.<\/p>\n<p>\u201c<em>This unexplained gap and revocation of the scheduled session raise serious questions about the legitimacy of the current Assembly and the constitutional health of the State<\/em>,\u201d the letter reads.<\/p>\n<p>The Congress further highlights that, in the absence of an elected government and with the continuing President\u2019s Rule in place, the ambiguity over the Assembly&#8217;s status not only undermines legislative accountability but also contributes to administrative paralysis in the already volatile state.<\/p>\n<p>Calling upon the Governor to act in his constitutional capacity, the letter adds, \u201c<em>You, being the constitutional authority, are requested to clarify the current legal status of the Manipur Legislative Assembly so that the people of the state may know whether their legislature still exists or has ceased to exist.\u201d<\/em><\/p>\n<p>Sources within the MPCC suggest that the party is also weighing legal options, should the Governor fail to respond adequately.
